Understanding Red Flag Laws

It is painfully clear that Liberal Democrats hate virtually everything that America has held dear for the past two-hundred plus years. From a basic tenet of our constitutional republic such as the electoral college, to now, supposedly radical concepts of due-process, our civil liberties are now being attacked with brutal force.

Case-in-point: Democrats in the House Judiciary Committee are working to push through HR1236, (still in committee) the Extreme Risk Protection Order Act of 2019, that will impose red flag gun laws across the nation. The gun control legislation is being heralded by radicals on the left as a way of stopping mass shootings before they happen.

But conservatives are pushing back against the law as subversion of constitutional rights, including: gun rights, property rights, and due process rights. One of those leading the charge to stop this bill from making it through the House is Representative Jim Jordan (R-OH). In a passionate speech within the committee, Jordan lambasted his colleagues for betraying their oath to the Constitution and for upending what the House Judiciary Committee was intended to do in protecting the Bill of Rights.
“WHAT OTHER CONSTITUTIONAL RIGHT CAN YOU LOSE WITHOUT DOING ANYTHING WRONG AND WITHOUT YOUR KNOWLEDGE, AND HAVE TO PETITION THE COURT TO GET IT BACK?” JORDAN ASKED. (https://youtu.be/9hZtn44WLqE)

Red flag gun laws such as HR1236 would allow various people to petition the court to have law enforcement remove firearms from people they believe to be a threat to themselves or others. It has gained in popularity following several mass shootings this summer, though none of them seem to have been preventable if such laws were in place.

As Jordan points out, the language of the bill makes it to where anyone who has lived with the accused in the last year, from an ex-girlfriend to a disgruntled roommate, can have the court remove firearms without the victim even knowing the process is happening.

In other words, accusers get the power to paint someone as guilty without due process, at which point they must then prove to the court they’re innocent. This isn’t how America is supposed to work.

At least 17 states now have approved some version of a red flag law, including Florida, New York, Connecticut, Illinois, Indiana and California. Before the 2018 mass shooting at Marjory Stoneman Douglas High School in Parkland, Fla., only five states had such laws.

California’s law is among the most elaborate. It was the first to permit family members to petition the courts directly for orders to confiscate weapons from relatives. Earlier laws in Connecticut and other states generally required the public to make reports to prosecutors or the police, who would decide whether to petition the courts. California’s law was enacted after a gunman killed six people and wounded 14 others in 2014 near the campus of the University of California, Santa Barbara.

New York’s is one of the most recent to be adopted. It allows teachers as well as family members and others to petition the courts for protective orders. (New York already had a law denying gun permits to people reported by mental health professionals to be a danger to themselves or others.)
Nevada and Hawaii have also approved red flag laws this year.

It is time to take a stand. Unless we become vocal opponents of these leftist agendas, our rights will continue to be stripped away. Stand with I.B Klicken,  #NoTrumpNoPeace, and other conservatives who are taking a stand for you.

I.B. Klicken is a nom de plume for a group of conservative writers wishing to remain anonymous. We're dedicated to being an outspoken voice for conservative values, combating the swamp-monsters of our day. Our concern for anonymity is due to calls for violence by radical members of the government and activist groups such as ANTIFA. We don’t fear for our own safety, but don’t wish for our loved ones and folks we care about to be put in harm's way because of our outspoken politics. The Hashtag #NoTrumpNoPeace is not a call for militancy, but rather, a blunt recognition of our current political atmosphere, where freedom of speech and the exchange of ideas are routinely attacked in the public forum.
